1. Scope of the general conditions
1.1. These general terms and conditions apply to all reservation requests and contracts concluded - directly or indirectly - with Campingpark Eifel GmbH and refer to all types of accommodation rented by Campingpark Eifel GmbH.
1.2. Campingpark Eifel GmbH expressly rejects the application of other general terms and conditions.
1.3. Exceptions to these general terms and conditions are only possible if the parties agree in writing.
2. Reservations
2.1 Campingpark Eifel GmbH only handles reservations if the person making the booking is older than 18 years. It reserves the right not to accept a reservation request without giving reasons.
2.2 The contract between Campingpark Eifel GmbH and the tenant comes into effect when Campingpark Eifel GmbH sends you the reservation confirmation - which is also the invoice - by post or email.
2.3 The tenant must check the reservation confirmation for accuracy and immediately report any inaccuracies to Campingpark Eifel GmbH.
2.4 The tenant makes a partial payment or payment to Campingpark Eifel GmbH within the deadline set in the reservation confirmation. Campingpark Eifel GmbH is entitled to consider the contract as not concluded if the agreed payment or partial payment is not received by Campingpark Eifel GmbH on time. In this case, Campingpark Eifel GmbH has the option of releasing the reserved accommodation for rental to third parties without further notice to the tenant and charging the tenant costs for the cancellation.
3. Changes to reservations
3.1 Campingpark Eifel GmbH is not obliged to make changes to the contract at the request of the tenant after the contract has been concluded. If Campingpark Eifel GmbH makes a change, it has the right to charge the tenant change costs, which amount to at least € 10 per change.
4. Prices
4.1 The tenant owes Campingpark Eifel GmbH the agreed rental price, as stated on the reservation confirmation.
4.2 The prices and additional costs are listed in the price list on the Campingpark Eifel GmbH website.
4.3 Unforeseen price increases imposed by authorities can be passed on to the tenant. All prices in the price list are subject to change and are subject to change.
4.4 Any discount campaigns do not apply to bookings that already exist/have been made.
5. Payment
5.1 The tenant must pay a deposit of twenty percent (20%) of the rental price as well as the full cost of cancellation insurance, the reservation costs and any costs for special requests within fourteen (14) days of making the reservation. 30 days before the arrival date, the tenant must pay the remaining 80 percent (80%) of the rental price and any additional costs.
5.2 If a reservation was made 30 days or less before the arrival date, the total amount must be paid by the tenant to Campingpark Eifel GmbH in accordance with the reservation confirmation within eight days of the reservation.
5.3 The tenant has no right to a (partial) refund of the travel contract if the tenant leaves before the agreed departure date.
5.4 Campingpark Eifel GmbH has the right to forfeit the reservation and to release the accommodation for rental to third parties without further notice if a payment deadline has expired and the tenant has not fulfilled his obligations.
5.5 Campingpark Eifel GmbH has the right to cancel the contract without notice of default or judicial intervention being necessary if: - the entire rental price is not paid at the beginning of the rental period - the deposit is not paid at the beginning of the rental period - the tenant leaves the rental property prematurely - the tenant fails to move into the rental property before 5:00 p.m. on the day on which the rental period begins without informing Campingpark Eifel GmbH in good time that the rental property will be moved into at a later point in the rental period.
6. Changeover days
6.1 Arrival and departure are possible on Monday and Friday, unless otherwise stated in the brochure. Campingpark Eifel GmbH states the day of arrival on the reservation confirmation.
6.2 The tenant can move into the rental property from 3 p.m. on the day of arrival and must leave the rental property before 10 a.m. on the day of departure.
7. Deposit
7.1 The tenant must pay a deposit upon arrival at reception or provide a written direct debit authorization for the deposit. Campingpark Eifel GmbH determines how Campingpark Eifel GmbH has to pay the deposit for the tenant.
7.2 The deposit serves as a security deposit for Campingpark Eifel GmbH. Any damage that the tenant causes to the rental property or within the holiday park during the rental period will be offset against the deposit. Additional costs, such as additional cleaning costs due to excessive contamination, can also be offset against the deposit.
7.3 Campingpark Eifel GmbH will destroy the direct debit authorization if no damage or additional costs are discovered during the final inspection of the apartment. If damage or additional costs are obviously discovered during the final inspection, the amount of the damage will be deducted from the tenant's account. The charge will never exceed the amount in accordance with the authorization. If the deposit is not sufficient to cover the damage and costs, Campingpark Eifel GmbH will subsequently collect the additional costs from the tenant.
7.4 Campingpark Eifel GmbH will refund the tenant any deposit paid in cash after the final inspection of the rental property, deducting any damages and costs.
8. (House) order
8.1 All guests must adhere to the rules issued by the park, including those set out in the park regulations. Campingpark Eifel GmbH has the right to immediately remove the tenant and people traveling with him from the park (or have them removed) if the house rules are violated or instructions from the staff are not followed. In this case, the tenant has no right to a refund of the rental price (or a corresponding part).
8.2 Campingpark Eifel GmbH reserves the right to make changes to the concept and opening times of the park's facilities. The tenant allows necessary maintenance work to be carried out on the rental property during the rental period. The tenant cannot claim any compensation. Campingpark Eifel GmbH decides at its discretion whether maintenance work is necessary. The tenant also allows maintenance work to be carried out on the park facilities during his stay.
8.3 The tenant uses the rental property exclusively as a holiday apartment.
8.4 The rental property is made available to the tenant when the keys are handed over. The keys will only be handed over if the full rental price and all additional costs have been received by Campingpark Eifel GmbH. The tenant delivers the keys to the park reception before 10 a.m. on the agreed departure date.
8.5 The landlord undertakes to hand over the rental property to the tenant clean and in good condition at the agreed time. The rental property with the existing inventory according to the inventory list is deemed to have been accepted by the tenant unless he has objected within four hours of moving into the rental property.
8.6 The tenant must grant employees of Campingpark Eifel GmbH direct access to the rental property at all times.
8.7 As a tenant of the rental property, you may not allow third parties to rent or use the rental property, nor may you allow more people to stay there than stated when making the reservation and named on the confirmation. Campingpark Eifel GmbH has the right to cancel the contract immediately and without legal intervention if it determines that the agreed number of people in the apartment is exceeded.
8.8 The tenant is obliged to treat the rental property and the associated inventory with care. The tenant leaves the rental property in a tidy and swept-clean condition upon departure. The tenant must report all damage caused to the rental property by the tenant or his fellow users to Campingpark Eifel GmbH before departure. This will be billed immediately.
8.9 The tenant is obliged to always lock the rental property properly when absent. Campingpark Eifel GmbH will invoice the tenant for any damage resulting from the tenant's breach of this obligation.
8.10 It is not permitted to use any equipment for cooking and washing purposes in the rental property other than those provided by Campingpark Eifel GmbH.
8.11 Any waste generated during your stay must be disposed of in the designated containers before 10 a.m. on the day of departure at the latest.
9. Pets
9.1 The price lists state whether the tenant is allowed to bring pets and, if so, how many pets are permitted per accommodation.
9.2 The tenant must indicate when booking whether he wishes to bring pets. The costs of a stay for pets are listed in the price list.
9.3 The tenant must follow any instructions from the park. Pets must not be a burden to other guests. Dogs must always be kept on a leash.
10. Force Majeure
Campingpark Eifel GmbH is entitled to provide the tenant with equivalent alternative accommodation if the rental property is not available due to force majeure or other circumstances. In this case, the tenant cannot take legal action against Campingpark Eifel GmbH.
11. Liability
11.1 Campingpark Eifel GmbH assumes no liability for theft (including theft from lockers in the swimming pool), loss or damage to or from property or people of any kind during or as a result of a stay in our park.
11.2 Campingpark Eifel GmbH assumes no liability for the fact that the tenant's stay at the park does not meet his expectations.
11.3 Campingpark Eifel GmbH assumes no liability for damage or injuries caused to property or people as a result of a stay on the site or through the use of the facilities available on the site.
11.4 Campingpark Eifel GmbH is not liable for claims for damages arising from noise nuisance from third parties.
11.5 Campingpark Eifel GmbH is not liable for damage resulting from information provided verbally or by telephone by its employees.
11.6 Campingpark Eifel GmbH is not liable if systems or facilities become damaged or unusable.
11.7 The tenant and accompanying persons are jointly and severally liable for any loss or damage to the rental property and other property of Campingpark Eifel GmbH (or the private house owner) that occurs during the rental period. This is regardless of whether the damage is the result of an act or omission by the tenant, the people traveling with him or third parties who are in the park because of the tenant.
11.8 The tenant is obliged to pay all additional costs that arise as a result of the incorrect use or incorrect leaving of the rental property. This provision includes, among other things, the leaving behind of excessive contamination. Campingpark Eifel GmbH can offset these additional costs against the deposit.
11.9 The tenant declares that he is aware of the location, furnishings and proper condition based on the (written) information provided, brochures, etc.
11.10 Almost all apartments belong to private owners. The furnishings/layout of the apartments can therefore be different.
11.11 It is possible that (part of the) park area is open or closed to a limited extent in certain weeks of the year. To be sure that all facilities are accessible during your stay, we recommend that the renter inquire about this when making the reservation. This will help you avoid possible disappointment upon arrival at the park.
12. Complaints
12.1 Despite all care and effort on the part of Campingpark Eifel GmbH, it may happen that you have cause for a complaint. Complaints must be reported immediately to the park reception. If the cause of a complaint cannot be resolved immediately or is not resolved to your satisfaction, you must record the complaint during your stay. To do this, you can use the complaint form available at reception. This complaint must be signed by a receptionist. You must then send the complaint form signed by the park, possibly with a cover letter, within eight days of the departure date to: Campingpark Eifel GmbH Schwimmbadstraße 7 54649 Waxweiler This action is absolutely necessary so that the complaint can be dealt with in the correct manner.
13. Cancellation conditions
13.1 If a reservation is canceled, Campingpark Eifel GmbH will charge the tenant a fixed compensation per accommodation in the amount of:
- 30% of the agreed rental price if canceled up to 42 days before the day of arrival.
- 60% of the agreed rental price in the event of cancellation from the 42nd day to the 28th day before the day of arrival.
- 90% of the agreed rental price in the event of cancellation from the 28th day to the day of arrival.
- 100% of the agreed rental price in the event of cancellation on the day of arrival or later.
